Terms of Service

1. Eligibility and Age Requirement

• Minimum age: You must be at least 17 years old to use the Service.
• Authority: You represent that you are legally able to accept these Terms.
• Underage access: We do not knowingly permit use by anyone under 17. We may terminate a session or restrict a device when we reasonably believe the age requirement has been violated.

2. Nature of the Service

• Ephemeral connections: MasqTap provides temporary, ad-hoc connections, including “Jump & Catch” and “Masquerade Ball” sessions. When a session closes, the connection ends and associated content is designed to be removed from temporary processing systems.
• No registration: MasqTap generally does not require a traditional account or personal profile.
• Semi-anonymous use: A nickname or avatar does not make conduct unaccountable and does not exempt any user from these Terms or applicable law.
• Service changes: Features may be added, modified, suspended, or discontinued as the Service evolves.

3. Prohibited Conduct

You may not use the Service to:

• harass, threaten, stalk, bully, intimidate, exploit, or demean another person;
• promote hatred or discrimination based on race, ethnicity, nationality, religion, sex, gender, sexual orientation, disability, or another protected characteristic;
• share illegal, violent, exploitative, non-consensual, or sexually abusive content;
• sexualize or exploit minors, or facilitate conduct that endangers a minor;
• send spam, scams, unsolicited advertising, malware, or malicious links;
• impersonate another person, a public authority, or a MasqTap representative;
• interfere with the Service, evade restrictions, probe security, scrape content, or attempt unauthorized access;
• use the Service for unlawful activity or to violate another person’s rights.

4. AI-Assisted Safety Monitoring and Enforcement

• Real-time processing: You acknowledge that MasqTap may use automated and AI-assisted systems to analyze text, audio, images, and video while content is being transmitted.
• Safety actions: MasqTap may block content, end a session, restrict functionality, or prevent a device from creating new connections when a violation is detected or reasonably suspected.
• Limited review: Because session content is designed to be ephemeral, MasqTap may be unable to investigate or reverse a moderation decision after the session ends.
• No guarantee: Automated moderation may not identify every violation and may occasionally restrict permitted content.

5. User Responsibility and Personal Safety

• You are responsible for your conduct and the content you choose to share.
• Use caution before sharing your location, legal name, contact details, financial information, passwords, or other sensitive information.
• Do not rely on a nickname, avatar, security code, or AI moderation as proof that another person is trustworthy.
• MasqTap does not control user conduct and is not responsible for meetings, transactions, or interactions that occur outside the Service.

6. User Content

You retain any rights you hold in content you submit. By submitting content, you grant MasqTap a limited, non-exclusive, royalty-free license to process, moderate, transmit, and display that content solely as necessary to operate and secure the Service. This license ends when the content is deleted under the Service’s ephemeral design, except to the limited extent processing is required by law or necessary to protect the Service.

You represent that you have the rights and permissions needed to share your content and that doing so does not violate law or another person’s rights.

7. MasqTap Intellectual Property

MasqTap Technologies, Inc. owns or licenses the Service, software, application design, branding, trademarks, graphics, and proprietary features associated with MasqTap, including the “Jump & Catch” and “Masquerade Ball” experiences. Except as permitted by law, you may not copy, modify, sell, distribute, reverse engineer, or create derivative works from the Service.

8. Third-Party Services

The Service may rely on third-party infrastructure or technology providers. Their availability and performance may affect the Service. References or links to third-party services do not constitute an endorsement, and those services may be governed by separate terms and privacy policies.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” TO THE MAXIMUM EXTENT PERMITTED BY LAW. MASQTAP DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, AND ERROR-FREE OPERATION.

MasqTap does not guarantee that content will always be blocked, that sessions will always be available, or that users will behave safely or lawfully.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MASQTAP TECHNOLOGIES, INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR USER INTERACTIONS.

Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MasqTap Technologies, Inc. and its affiliates from claims, liabilities, damages, losses, and expenses arising from your misuse of the Service, your content, your violation of these Terms, or your violation of another person’s rights.

12. Suspension and Termination

MasqTap may suspend, restrict, or terminate access without prior notice when reasonably necessary to protect users, enforce these Terms, comply with law, prevent abuse, or protect the integrity of the Service. You may stop using the Service at any time.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Unless applicable law requires otherwise, legal proceedings arising from these Terms or the Service must be brought in a state or federal court located in Delaware, and you consent to that jurisdiction and venue.

14. Export Controls and Sanctions

You may not use, export, or access the Service in violation of United States export-control laws, sanctions, or other applicable trade restrictions.

15. Changes to These Terms

We may update these Terms as the Service, technology, or law evolves. The “Last Updated” date will identify the latest version. Continued use after updated Terms become effective constitutes acceptance of those Terms, to the extent permitted by law.

16. General Provisions

If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Community Guidelines, form the agreement between you and MasqTap concerning the Service.
